Terms of Service

RememberWith.AI is a product of Pulse Insights LLC, a Delaware limited liability company ("Pulse Insights," "RememberWith," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at rememberwith.ai, our AI-powered story capture service, and all related features and functionality (collectively, the "Service").
By creating an account, making a payment, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What RememberWith Does
RememberWith is an AI-powered family story capture platform. Our Service enables storytellers to share life stories through phone conversations with an AI interviewer. These conversations are transcribed, organized into stories, and made available to authorized family members through a private, searchable archive.
RememberWith is not a therapy service, crisis line, or legal advisor. Our AI interviewer is designed to listen, ask thoughtful follow-up questions, and help storytellers share their memories. It is not a substitute for professional mental health care, legal counsel, or emergency services.
2. Accounts and Ownership
2.1 Account Holder
The "Account Holder" is the individual or entity responsible for payment. The Account Holder has administrative authority over the account, including the ability to manage family members, request data exports, and close the account. However, the Account Holder's authority does not extend to overriding the Storyteller's privacy choices (see Section 6).
2.2 Storytellers
A "Storyteller" is the individual whose stories are being captured through the Service. The Storyteller may or may not be the Account Holder. When the Account Holder and the Storyteller are different people (for example, when an adult child purchases the Service for a parent), both parties should understand and agree to these Terms.
2.2.1 Storyteller Privacy Sovereignty
While the Storyteller is alive, the Storyteller has sole authority over which stories are shared with family members and which remain private. This authority is independent of who pays for the account. The Account Holder controls billing and family membership. The Storyteller controls story privacy.
2.3 Family Members
"Family Members" are individuals granted access to view stories by the Account Holder. Family Members may browse, search, and read stories that have been shared by the Storyteller, but they do not have administrative control over the account.
2.4 Account Succession and Estate Transfer
If the Account Holder or Storyteller passes away or becomes permanently incapacitated, the account is treated like any other digital asset and passes to the estate in accordance with applicable law. We will work with authorized estate representatives (with appropriate documentation) to transfer account access, export data, or close the account.
2.5 Eligibility
You must be at least 18 years old to create an account. The Service is designed for adult storytellers. We do not knowingly collect stories from individuals under 18.
3. The AI Interviewer
3.1 AI Disclosure
Our interviewer is an artificial intelligence system, not a human. In accordance with applicable law, including California AB 2905, we disclose this at the beginning of every conversation. The AI will identify itself and will never represent itself as human.
3.2 Limitations of AI
The AI interviewer may occasionally misunderstand, misattribute, or inaccurately transcribe statements. Storytellers are encouraged to review their transcripts and stories through the Service and request corrections. AI-generated summaries, narrative chapters, and other derived content represent the AI's interpretation of what was shared and may not perfectly reflect the Storyteller's intent.
3.3 Sensitive Topics
Life stories naturally include difficult experiences. Our AI is designed to listen respectfully to whatever the Storyteller chooses to share, including painful memories, without redirecting or minimizing those experiences. The AI will not attempt to provide therapy, medical advice, or legal counsel. If our system detects signs of acute distress during a conversation, we may provide contact information for relevant support resources (such as the 988 Suicide and Crisis Lifeline) at the end of the session.
3.4 Not a Substitute for Human Connection or Professional Care
The AI interviewer is designed to help capture family stories. It is not a companion, therapist, counselor, or emotional support service. Extended or frequent use of the Service is not a substitute for human relationships or professional mental health care.
We encourage Storytellers to share their stories with the people in their lives, not just with our AI. The purpose of RememberWith is to create a lasting record for your family, not to replace the conversations you have with them.
If you or someone you know is experiencing a mental health crisis, please contact the 988 Suicide and Crisis Lifeline (call or text 988), the Crisis Text Line (text HOME to 741741), or your local emergency services.
4. Recording, Consent, and Phone Calls
4.1 All Calls Are Recorded
Every phone conversation with our AI interviewer is recorded, transcribed, and processed by our Service. We treat every call as requiring all-party consent regardless of your state's laws. At the beginning of each call, our AI will:
- Identify itself as an AI system
- State that the call is being recorded
- Ask for the Storyteller's verbal consent to proceed
If the Storyteller does not consent, the call will end. Continued participation in the call after this disclosure constitutes consent to recording.
4.2 How Recordings Are Used
Recordings and transcripts are used to:
- Extract and organize stories for the Storyteller's private archive
- Generate narrative summaries and chapter groupings
- Create searchable embeddings so family members can find stories by meaning, person, place, or time period
- Improve the quality of the AI interviewer's follow-up questions within and across sessions
Recordings and transcripts are not used to train third-party AI models, sold to third parties, or used for advertising purposes.
5. Content Ownership and Licensing
5.1 Your Content
"Your Content" means all stories, transcripts, audio recordings, and information provided by the Storyteller through the Service. You own Your Content. We do not claim ownership of your stories.
5.2 License to Operate the Service
By using the Service, you grant RememberWith a limited, non-exclusive, non-transferable license to process, store, transcribe, analyze, and display Your Content solely for the purpose of providing and improving the Service. This license exists only for as long as your account is active and terminates upon account deletion, except as required by law.
5.3 AI-Generated Content
Content generated by our AI, including narrative chapters, story summaries, and search results, is derived from Your Content and is provided to you as part of the Service. You may use, copy, and share AI-generated content derived from your stories for personal, non-commercial purposes.
6. Privacy of Stories
6.1 Default to Shared
Stories default to shared with family. The purpose of RememberWith is to preserve stories for family members to read, search, and explore. When a Storyteller shares a story through the Service, that story is visible to authorized Family Members by default.
6.2 Privacy Controls
The Storyteller controls which stories are visible to Family Members. Only the Storyteller can change a story's privacy, regardless of who pays for the account. Each story can be set to: Shared with family, Kept private for now, Share later, or Just for me.
6.3 Sensitivity Detection
Our AI interviewer may detect when a Storyteller shares something particularly sensitive, such as a family conflict, an explicit request for privacy, or a deeply personal admission. When this happens, the AI will ask the Storyteller at the end of the session whether they would like that story shared with family or kept private. If the Storyteller does not clearly confirm sharing, the story defaults to private.
7. Important Legal Realities About Confidentiality
7.1 Stories Are Not Legally Privileged
There is no recognized "oral history privilege" in United States law. Unlike communications with attorneys, doctors, or clergy, stories shared with RememberWith are not protected by any legal privilege. This means that your stories, transcripts, and recordings could be subject to subpoena or other legal process by law enforcement or in civil litigation.
7.2 Mandatory Reporting
In many U.S. states, any person who learns of ongoing abuse of a child or vulnerable adult may be legally required to report it to authorities. If our team becomes aware, through support interactions, quality review, or automated content analysis, of a disclosure that appears to describe ongoing abuse of a child or vulnerable adult, we may be legally obligated to report it.
8. SMS Messaging Program
8.1 Program Name and Description
RememberWith.AI SMS is operated by Pulse Insights LLC. We send SMS messages to support the RememberWith.AI family story capture service. The program is transactional and low-volume. We do not send marketing or promotional SMS messages.
8.2 Message Types
The RememberWith SMS program sends the following message types:
- Account setup links after a Storyteller's first phone call, so they can manage their stories on the web
- Family member invitations when a registered family member invites someone to join the family story archive
- Question notifications when a family member submits a question for the Storyteller to answer
- Service notifications such as session confirmations, account changes, or important service updates
8.3 Consent to Receive SMS
By providing your phone number and explicitly opting in, you consent to receive transactional SMS messages from RememberWith.AI. Consent is collected through one of three methods:
- Web signup (express written consent): At rememberwith.ai/onboarding or rememberwith.ai/join, you enter your mobile number, verify it via a one-time code, and check an unchecked consent box agreeing to receive SMS. A public preview of this flow is available at rememberwith.ai/sms-signup for compliance verification.
- First call (verbal consent): During your first call with the AI interviewer, the AI verbally informs you that a follow-up text will be sent and asks for your agreement before proceeding.
- Family invitation (third-party initiated, with attestation): A registered family member enters your name and phone number on the Settings page and attests that you are a close family member who would welcome the invitation. The resulting one-time SMS identifies the inviter by name.
Consent is not a condition of purchase of any goods or services. Consent to receive SMS is separate from these Terms; you can use the Service without opting in to SMS by using email and phone-call channels only.
8.4 Message Frequency
SMS messaging is low-volume. You may receive approximately 1 to 5 messages per month depending on your activity. You will not receive more than 10 SMS messages from us in any single month.
8.5 Message and Data Rates
Message and data rates may apply. Consult your wireless carrier for details about your messaging plan. RememberWith.AI does not charge for SMS messages, but your carrier may.
8.6 Opt-Out Instructions
You can opt out of SMS messages at any time by replying STOP to any message from RememberWith.AI. You may also reply CANCEL, END, UNSUBSCRIBE, or QUIT. Opt-out requests are processed immediately. After opting out, you will receive a single confirmation message and no further SMS messages.
Opting out of SMS does not affect your ability to use the Service via phone calls or the web. To opt back in, reply START.
8.7 Help
For help with SMS messaging, reply HELP to any message, or contact us at [email protected]. The HELP auto-reply provides our contact information and a brief description of the program.
8.8 Mobile Information — Third Parties and Affiliates
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support of our services (e.g., Twilio for SMS delivery, Supabase for storage) is permitted under standard service-provider terms. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
RememberWith does not engage in affiliate marketing, lead generation for third parties, or selling/sharing of consumer data. We do not partner with third-party advertisers, marketing networks, or data brokers. Our SMS program exists solely to support our own Service for our own users.
8.9 Supported Carriers
SMS messages are delivered via major US carriers including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.
9. Prohibited Uses
You may not use the Service to:
- Record or capture stories from individuals who have not consented
- Upload or submit content depicting, describing, or promoting child sexual abuse material
- Harass, defame, or threaten others
- Impersonate another person
- Attempt to extract, reverse-engineer, or misuse our AI systems
- Use the Service for any commercial purpose without our prior written consent
- Use the AI interviewer as a substitute for professional mental health care, crisis support, or emotional companionship
- Violate any applicable law
We reserve the right to suspend or terminate accounts that violate these Terms.
9.1 Usage Limits and Fair Use
RememberWith is designed for periodic story capture sessions, not continuous or all-day interaction with the AI interviewer. We may impose reasonable limits on session duration, session frequency, or total usage across any channel (phone, web chat, or other) to ensure the Service operates as intended and to protect the well-being of our users.
10. Payment and Billing
10.1 Subscription
Access to the Service requires a paid subscription. Pricing, billing frequency, and included features are described on our website and may change with notice.
10.2 Refunds
Refund policies are described at the time of purchase. Because our Service involves real-time AI processing and telephony costs, we generally cannot offer refunds for completed sessions.
10.3 Account Standing
If payment fails or a subscription lapses, we will retain Your Content for a grace period of 90 days. During this period, you may renew your subscription to restore full access or request a data export.
11. Your Right to Your Data
11.1 Data Export
You may request a complete copy of all Your Content at any time by contacting us. We will provide your data in a standard, portable format within 30 days of your request.
11.2 Data Deletion
You may request deletion of your account and all associated data at any time. Active data is permanently deleted within 30 days. Backup copies are purged within 90 days. Deletion is irreversible.
12. Third-Party Services
RememberWith uses third-party services to operate. By using our Service, you acknowledge that Your Content is processed by Anthropic, Twilio, Deepgram, ElevenLabs, OpenAI (via OpenRouter), Supabase, and Cloudflare. We select providers whose data handling practices align with our commitments to you. None of these providers use Your Content to train their AI models when accessed through their API services. See our Privacy Policy, Section 3.2, for a full table of subprocessors.
13. Disclaimers and Limitation of Liability
13.1 Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy of transcriptions, the quality of AI-generated content, or the uninterrupted availability of the Service.
13.2 Limitation of Liability
To the maximum extent permitted by law, RememberWith's total liability for any claims arising from your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
13.3 Accuracy
We do not guarantee the accuracy of transcriptions, AI-generated summaries, or any derived content.
13.4 No Guarantee of Perpetual Availability
We intend to operate the Service for the long term and take reasonable measures to protect Your Content. However, we do not warrant or represent that the Service or Your Content will be available indefinitely. We strongly encourage all users to periodically export their data as an additional safeguard.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved through binding arbitration in Newton, Massachusetts, except that either party may seek injunctive relief in court for intellectual property matters or urgent protective orders.
